Secretly ("we," "our," or "us") operates the Secretly desktop application and the website at secretly.app (collectively, the "Service"). This Privacy Policy explains how we collect, use, and protect your information when you use our Service.

By using Secretly, you agree to the collection and use of information as described in this policy. If you do not agree, please do not use the Service.

2. Information We Collect

2.1 Account Information

When you purchase a subscription, our payment processor (Paddle) collects your email address, name, and payment details. We receive your email address and subscription status but do not store your full payment card information.

2.2 Usage Data

We may collect anonymous, aggregated usage statistics such as feature usage frequency, session duration, and error reports. This data does not identify you personally and is used solely to improve the Service.

2.3 Data We Do NOT Collect or Store

Secretly is designed with privacy as a core principle. We do not collect, store, or transmit:

• Audio recordings or voice data from your microphone
• Transcriptions of your conversations
• Screenshots or screen capture data
• AI-generated responses
• Content of your meetings or interviews
• Your custom persona configurations

All transcription, screen analysis, and AI processing occurs in real-time and is discarded immediately after use. Nothing is persisted on our servers.

3. How We Process AI Requests

When you use cloud-based AI models through Secretly, your queries are routed through our secure encrypted servers located in the United States. These servers act as a proxy to forward requests to AI providers and return responses. We do not log, store, or inspect the content of these requests or responses.

If you choose to use local AI (on-device processing), your data never leaves your computer. All processing happens entirely on your machine with no network requests made.

4. Third-Party Services

We use the following third-party services:

• Paddle — Payment processing, subscription management, and tax compliance. Paddle acts as the Merchant of Record for all transactions, meaning Paddle is the legal seller of the product and handles billing, invoicing, tax collection, and remittance on our behalf. Subject to Paddle's Privacy Policy.
• AI Model Providers — When using cloud AI, your queries are processed by third-party AI providers. Each provider has their own data handling policies. We do not share your identity with these providers.

5. Data Security

We implement industry-standard security measures to protect your data in transit and at rest. All communication between the Secretly app and our servers uses TLS encryption. API credentials are never stored on your device — all authentication is handled server-side through our secure proxy infrastructure.

6. Data Retention

We retain your account information (email and subscription status) for as long as your account is active. If you cancel your subscription, we retain this data for up to 90 days for billing reconciliation purposes, after which it is permanently deleted.

We do not retain any content data (transcriptions, screen captures, AI responses) as this data is never stored in the first place.

7. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

• Access — Request a copy of the personal data we hold about you.
• Deletion — Request deletion of your personal data.
• Correction — Request correction of inaccurate data.
• Portability — Request your data in a portable format.
• Objection — Object to processing of your personal data.

8. International Data Transfers

Our AI proxy servers are located in the United States. If you are accessing Secretly from outside the United States, please be aware that your AI queries are processed through US-based servers. By using the Service, you consent to this transfer. You may avoid international data transfers entirely by using local AI processing.

9. Children's Privacy

Secretly does not knowingly collect personal information from children under 13. If we become aware that we have collected data from a child under 13, we will take steps to delete it promptly. If you believe a child has provided us with personal data, please contact us at support@secretly.app.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by posting the updated policy on our website with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated policy.
