1. Acceptance of Terms

By downloading, installing, or using Secretly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Secretly is operated by Secretly ("we," "our," or "us"), operated by Prasham Jain, an individual based in Pune, Maharashtra, India.

2. Description of Service

Secretly is a desktop application that provides real-time AI assistance during meetings and interviews. The application uses stealth display technology to remain invisible during screen sharing on supported platforms. The Service includes a free tier with limited functionality and paid subscription tiers with additional features.

3. Eligibility

You may use Secretly if you are legally capable of entering into a binding agreement in your jurisdiction. By using the Service, you represent that you have the authority to agree to these Terms.

4. Account and Subscriptions

4.1 Free Tier

The free tier provides 10 lifetime AI responses with limited features. No account or payment information is required to use the free tier.

4.2 Paid Subscriptions

Paid subscriptions (Pro, Pro+, and Enterprise) are billed monthly or annually through our payment processor, Paddle. By subscribing, you authorize recurring charges at the applicable rate until you cancel.

4.3 Pricing Changes

We reserve the right to modify subscription pricing at any time. Price changes will not affect your current billing period. You will be notified of any price changes at least 30 days in advance via the email associated with your account.

5. Cancellation

You may cancel your subscription at any time through your Secretly account dashboard (powered by Paddle). Upon cancellation:

  • Your paid features remain active until the end of your current billing period.
  • You will not be charged for subsequent billing periods.
  • After your billing period ends, your account reverts to the free tier.

No refunds are issued for cancellations. Please see our Refund Policy for details.

6. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or disassemble the Secretly application.
  • Redistribute, sublicense, or resell access to the Service.
  • Use the Service to violate any applicable laws or regulations.
  • Attempt to circumvent subscription limits, licensing restrictions, or security measures.
  • Use automated systems to abuse the AI response quotas or infrastructure.
  • Share your account credentials with others or operate a shared account.

7. Intellectual Property

All content, code, design, and technology comprising Secretly is owned by Secretly and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal purposes in accordance with these Terms.

AI-generated responses produced during your use of the Service are yours. We claim no ownership over content generated for you by AI models through Secretly.

8. User Responsibility

You are solely responsible for how you use the Service and any consequences that arise from your use. Secretly provides AI assistance as a tool — you are responsible for evaluating and applying AI-generated responses at your own discretion.

You acknowledge that the use of AI assistance during interviews, examinations, or assessments may be subject to rules or policies set by the interviewing or examining party. It is your responsibility to understand and comply with any such rules.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • AI-generated responses will be accurate or complete.
  • The screen sharing invisibility feature will function on all platforms or configurations.
  • The Service will meet your specific requirements.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Secretly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising out of your use of the Service.

In no event shall our total aggregate liability exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to violation of these Terms, fraudulent activity, or abuse of the Service.

Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination will survive, including intellectual property, limitation of liability, and dispute resolution sections.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
